Subclass 186 – Employer Nomination Scheme Visa

This visa lets skilled workers, who are nominated by their employer, live and work in Australia permanently.

Streams under this visa:

  • Direct Entry Stream:
    This is a permanent visa that lets you stay in Australia indefinitely.
  • Your occupation must be on the relevant occupation list.
  • You must have relevant work experience.
  • You must be licensed, registered, or a member of a professional body if it is mandatory in the state or territory where you intend to work.
  • You must have a positive skills assessment.
  • You must be nominated by an Australian employer.
  • You must be under 45 years of age when you apply, unless exempt.
  • You must have at least competent English.

 

  • Temporary Residence Transition Stream:
    This is a permanent visa that allows you to stay in Australia indefinitely. It is available to applicants transitioning from a subclass 457 or 482 visa. To be eligible, you must have worked in your nominated and sponsored occupation for at least 2 years full-time while holding a subclass 457 or 482 visa.
  • You must have the required skills and qualifications needed to perform the tasks of the nominated occupation.
  • You must have completed 2 years of eligible sponsored employment in the 3 years prior to your application.
  • You must be licensed, registered, or a member of a professional body if it is mandatory in the state or territory where you intend to work.
  • You must be nominated by the employer who sponsored your temporary work visa.
  • You must be under 45 years of age when you apply, unless exempt.
  • You must have at least competent English.

 

  • Labour Agreement Stream (Subclass 186 – Employer Nomination Scheme)

This is a permanent visa that allows you to stay in Australia indefinitely. It is for skilled workers who are nominated by an employer under a Labour Agreement approved by the Australian Government.

  • You must be nominated by an employer who has a Labour Agreement with the Australian Government.
  • Your occupation must be included in the Labour Agreement.
  • You must meet the age requirements specified in the agreement. (Some agreements allow age exemptions.)
  • You must meet the skills, qualifications, and work experience requirements as outlined in the specific Labour Agreement.
  • You must meet the English language requirements specified in the Labour Agreement.
  • You must hold any mandatory licensing, registration, or membership required for your occupation in the state or territory where you will work.
  • You must meet any additional conditions or criteria set out in the specific Labour Agreement under which you are being sponsored.

Subclass 482 – Skills in Demand Visa

This temporary visa lets an employer sponsor a suitably skilled worker to fill a position they can’t find a suitably skilled Australian to fill.
Streams under this visa:

  • Core Skills Stream: With this visa, you can work in Australia for your sponsor for up to 4 years, or up to 5 years if you are a Hong Kong passport holder.
    Before you can apply, your employer must lodge a nomination application. They can only do this if they are an approved Standard Business Sponsor, or if they have at least submitted an application to become one.
  • Be nominated by an approved sponsor.
  • Your occupation must be on the relevant occupation list.
  • You must have the skills, qualifications and employment background required to perform the occupation.
  • You must have worked in your nominated occupation or a related field for at least 1 year.
  • You must meet the minimum English language requirements, unless exempt.
  • Specialist Skills Stream: With this visa you can work in Australia for your sponsor for up to 4 years, or up to 5 years if you are a Hong Kong passport holder. Before you can apply for a SID visa, your proposed employer will need to submit a nomination application for you. They will only be able to do this if they are an approved sponsor or have at least submitted an application to become a Standard business sponsor.
    • Be nominated by an approved sponsor.
    • Your employer must nominate you to fill an ANZSCO-listed occupation, excluding those in Major Groups 1, 2, 4, 5 or 6, where the nominated salary meets the Specialist Skills Income Threshold.
    • You must have the skills, qualifications and experience required to perform the occupation.
    • You must have worked in your nominated occupation or a related field for at least 1 year. You must meet the minimum English language requirements, unless exempt.
  • Labour Agreement Stream: This visa is for skilled workers nominated by employers who have a Labour Agreement. It lets you live and work in Australia temporarily. Labour agreements are developed between the Australian Government (represented by the Department) and employers. With this visa you can work in Australia for your sponsor for up to 4 years, or up to 5 years if you are a Hong Kong passport holder.
    • Be working under a labour agreement
    • You must be nominated.
    • Have at least 1 year of work experience, unless otherwise specified in the Labour Agreement.
    • Have a level of English language suitable for your occupation

Subclass 494 – Skilled Employer Sponsored Regional (Provisional) visa

This is a provisional visa that allows skilled workers to live, work and study in designated regional areas of Australia for up to 5 years. You must be sponsored by an approved employer for a position located in a designated regional area.

Streams under this visa:

  • Employer sponsored stream: This stream allows an employer in a designated regional area to sponsor a skilled worker for a position they cannot fill locally.
  • You must be nominated by an employer whose business is lawfully operating in Australia.
  • The nominated position must be in a designated regional area.
  • Your occupation must be on the relevant skilled occupation list.
  • You must have a positive skills assessment, unless exempt.
  • You must have at least 3 years full-time relevant work experience in your occupation.
  • You must be under 45 years of age, unless exempt.
  • You must have at least competent English, unless exempt.
  • You must meet any licensing, registration or professional membership requirements for the role.
  • Labour Agreement Stream: This stream is for skilled workers nominated by employers who have a labour agreement. Labour agreements are developed between the Australian Government (represented by the Department) and employers.
    • Your occupation must be included in the labour agreement.
    • You must meet the age, English, skills and work experience requirements specified in the labour agreement.
    • You must have any required licensing, registration or professional membership for the role.
    • You must live, work and study in a designated regional area as outlined in the labour agreement.

Subclass 407 – Training Visa

This visa allows you to take part in workplace-based occupational training activities to improve your skills for your job, area of tertiary study, field of expertise or in a professional development training program in Australia.

  • Your sponsor must be approved as a temporary activities sponsor.   
  • Your sponsor must have nominated you to participate in a program of occupational training unless your sponsor is a Australian Commonwealth Government agency. Nomination requirements are different depending on the purpose or type of training. There are 3 types of occupational training covered by this visa:
    • Occupational training required for registration
    • Occupational training to improve skills in an eligible occupation
    • Occupational training for capacity building overseas. This includes overseas qualification, government support or professional.
